1. Who we are

Throughout these Terms we call ourselves “Rooftop Moments”, “we”, “us” and “our”. The “Apps” mean all mobile or web applications we publish, including but not limited to Bond, DeepDive and any future titles.

2. Acceptance & Eligibility

By downloading, installing, or using any App you agree to these Terms. You must be at least 16 years old (or the age required in your country to consent to data processing) and legally capable of forming a contract.

3. Licence to use the Apps

• We grant you a personal, non-exclusive, revocable licence to use the Apps solely for your own non-commercial purposes on a device you own or control and in accordance with the rules set out in the Apple App Store and Google Play Store terms.
• All intellectual-property rights in the Apps and their content are owned by Rooftop Moments or its licensors.
• You must not copy, reverse engineer, decompile, sell, rent, or otherwise exploit the Apps except as expressly permitted by law.

4. Content you provide & AI output

• You may submit text, images, audio and other materials (“User Content”). You retain ownership of your User Content, but grant us and our processors a worldwide licence to process it for the purpose of providing the Services.
• We route your User Content through our own servers and onward to third-party AI providers (currently OpenAI LLC and Google LLC Gemini). Their terms of service and privacy policies also apply to your use of the Apps.
• AI-generated output can be inaccurate or inappropriate. The Apps do not provide medical, legal or professional advice. You use any output at your own risk.

5. Prohibited conduct

• No use that violates law, infringes third-party rights, or harms others.
• No attempt to overload, interfere with, or bypass the request limits or security of our or our providers’ systems.
• No collection of personal data of other users.

6. In-App purchases & subscriptions

Payment processing is handled by Apple or Google. Any billing questions, refunds, or cancellations must be made through the storefront used for the purchase. All prices include applicable VAT unless stated otherwise.

7. Disclaimer of warranties

The Apps are provided “as is” and “as available” without warranties of any kind. To the extent allowed by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

8. Limitation of liability

We are liable without limitation for intent and gross negligence and for injury to life, limb or health. For ordinary negligence we are liable only for breach of essential contractual duties and limited to the typical foreseeable loss. Nothing in these Terms restricts consumer rights that cannot be waived under applicable law.

9. Indemnity

You will indemnify us against all claims, damages and expenses arising from your breach of these Terms or misuse of the Apps.

10. Governing law & disputes

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules. If you are a consumer resident in the EU or UK, you additionally benefit from mandatory protections afforded to you by the laws of your habitual residence. We do not participate in alternative dispute-resolution procedures before a consumer arbitration board and are not obliged to do so.

11. Changes

We may change these Terms to reflect updates to the Apps or legal requirements. We will give reasonable notice (e.g. via the App or website). Your continued use after the effective date constitutes acceptance.
